How Spreekwafel collects, uses, stores, and protects your personal data when you use our Dutch language learning application.
01Introduction
[Company Name] ("we", "us", "our") operates the Spreekwafel mobile application ("the App"), a Dutch language learning application designed to help adult professionals build speaking confidence through AI-powered feedback.
This Privacy Policy explains how we collect, use, store, and share your personal data when you use the App. We are committed to protecting your privacy in compliance with the EU General Data Protection Regulation (GDPR) and the Dutch Implementation Act of the GDPR (Uitvoeringswet AVG / UAVG).
02Information We Collect
2.1 Information You Provide
- Account information: name, email address, password (stored as a hash), preferred language, time zone.
- Profile information: proficiency level (A2/B1/B2), learning goals, organization (if registered through a B2B account).
- Authentication via Google Sign-In: when you choose to sign in with Google, we receive your name, email address, and Google account ID. We do not receive your Google password.
2.2 Information Generated Through Use
- Voice recordings: when you complete speaking practice exercises, we record your voice via your device's microphone.
- Transcriptions and AI feedback: text transcriptions of your recordings and AI-generated pronunciation, grammar, and fluency feedback.
- Learning progress: completed modules, attempts, scores, time spent, confidence scores.
- Vocabulary and phrase data: words and phrases you save to your personal bank, written exercise submissions.
2.3 Information Collected Automatically
- Device and usage data: device model, operating system version, app version, IP address, language settings, time zone, crash logs, performance data.
- Activity logs: features used, session duration, in-app interactions for analytics.

04Microphone & Voice Recording Disclosure
The App requests access to your microphone to record your spoken Dutch during practice exercises. These recordings are essential to the core functionality of the App. We:
- Record your voice only when you actively start a speaking exercise.
- Upload the recording to our secure cloud storage (AWS) for AI processing.
- Send a copy of the recording to OpenAI for transcription and pronunciation analysis.
- Store the recording, transcription, and feedback in your account for your future review.
We do not record your voice in the background or outside of practice exercises.
05Third-Party Services and Data Sharing
We share your data only with the following processors, and only as necessary to provide the App:

We do not sell your personal data, share it with advertisers, or use it for advertising profiling.
06International Data Transfers
Some of our processors are located outside the European Economic Area (EEA), including:
- AWS (India)
- OpenAI (United States)
When we transfer your data outside the EEA, we rely on the European Commission's Standard Contractual Clauses (SCCs) and, where applicable, additional safeguards to ensure your data receives an equivalent level of protection as required under Chapter V of the GDPR.
07Data Retention
- Account data: retained for as long as your account is active.
- Voice recordings, transcriptions, and feedback: retained while your account is active.
- After account deletion: all personal data, including voice recordings, will be deleted within 90 days of your deletion request.
- Anonymized analytics: data that no longer identifies you may be retained indefinitely for product improvement.
- Legal obligations: where Dutch law requires us to retain data (e.g., for tax or fraud-prevention purposes), we will do so for the legally required period.
08Data Security
We protect your data using industry-standard measures, including:
- TLS/HTTPS encryption for all data in transit.
- Encryption at rest for stored recordings and database records.
- Bcrypt password hashing.
- JWT-based authentication with short-lived access tokens.
- Role-based access controls within our team.
- Regular security reviews of our infrastructure.
No system is 100% secure. We will notify you and the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) of any personal data breach as required by GDPR Articles 33 and 34.
09Your Rights (GDPR)
You have the following rights regarding your personal data:
- Right of access (Art. 15): request a copy of the personal data we hold about you.
- Right to rectification (Art. 16): correct inaccurate or incomplete data.
- Right to erasure (Art. 17): request deletion of your data ("right to be forgotten").
- Right to restriction (Art. 18): limit how we process your data.
- Right to data portability (Art. 20): receive your data in a machine-readable format.
- Right to object (Art. 21): object to processing based on legitimate interest.
- Right to withdraw consent: where processing is based on consent, you may withdraw it at any time.

10Account Deletion
You can request deletion of your account and all associated data at any time:

11Children's Privacy
The App is intended for users aged 13 and older. We do not knowingly collect personal data from children under 13.
For users in the Netherlands and the EU between 13 and 16, the GDPR (as implemented in the Netherlands via the UAVG) requires verifiable parental consent for processing personal data. If you are between 13 and 16, please ensure your parent or guardian has consented to your use of the App.
If we discover that we have collected data from a child under 13 (or under 16 without parental consent in the EU), we will delete it promptly. Parents or guardians who believe their child has provided personal data may contact us at jackyvanderstarre@gmail.com.
12Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of material changes through the App or by email. The "Last Updated" date at the top will reflect the most recent revision. Continued use of the App after changes constitutes acceptance of the updated policy.

14Governing Law

01Inleiding

02Welke gegevens wij verzamelen
2.1 Gegevens die u verstrekt
- Accountgegevens: naam, e-mailadres, wachtwoord (opgeslagen als hash), voorkeurstaal, tijdzone.
- Profielgegevens: vaardigheidsniveau (A2/B1/B2), leerdoelen, organisatie (indien geregistreerd via een B2B-account).
- Authenticatie via Google Sign-In: wanneer u inlogt met Google, ontvangen wij uw naam, e-mailadres en Google-account-ID. Wij ontvangen niet uw Google-wachtwoord.
2.2 Gegevens gegenereerd door gebruik
- Spraakopnames: wanneer u spreekoefeningen voltooit, nemen wij uw stem op via de microfoon van uw apparaat.
- Transcripties en AI-feedback: tekstuele transcripties van uw opnames en door AI gegenereerde feedback over uitspraak, grammatica en vloeiendheid.
- Leervoortgang: voltooide modules, pogingen, scores, bestede tijd, vertrouwensscores.
- Vocabulaire en zinsgegevens: woorden en zinnen die u aan uw persoonlijke woordenschat toevoegt, schrijfopdrachten die u inlevert.
2.3 Automatisch verzamelde gegevens
- Apparaat- en gebruiksgegevens: apparaatmodel, besturingssysteemversie, app-versie, IP-adres, taalinstellingen, tijdzone, crashlogs, prestatiegegevens.
- Activiteitenlogs: gebruikte functies, sessieduur, in-app interacties voor analyse.
03Hoe wij uw gegevens gebruiken

04Microfoon- en spraakopname-verklaring
De App vraagt toegang tot uw microfoon om uw gesproken Nederlands op te nemen tijdens oefeningen. Deze opnames zijn essentieel voor de kernfunctionaliteit van de App. Wij:
- Nemen uw stem alleen op wanneer u actief een spreekoefening start.
- Uploaden de opname naar onze beveiligde cloudopslag (AWS) voor AI-verwerking.
- Sturen een kopie van de opname naar OpenAI voor transcriptie en uitspraakanalyse.
- Slaan de opname, transcriptie en feedback op in uw account voor toekomstige raadpleging.
Wij nemen uw stem niet op de achtergrond of buiten oefeningen op.
05Derden en gegevensdeling
Wij delen uw gegevens uitsluitend met de volgende verwerkers, en alleen voor zover noodzakelijk om de App te leveren:

Wij verkopen uw persoonsgegevens niet, delen ze niet met adverteerders en gebruiken ze niet voor reclameprofilering.
06Internationale gegevensoverdrachten
Sommige verwerkers bevinden zich buiten de Europese Economische Ruimte (EER), waaronder:
- AWS (India)
- OpenAI (Verenigde Staten)
Bij overdracht van uw gegevens buiten de EER baseren wij ons op de Standaardcontractbepalingen (SCC's) van de Europese Commissie en, waar van toepassing, aanvullende waarborgen om een gelijkwaardig beschermingsniveau te garanderen zoals vereist onder Hoofdstuk V van de AVG.
07Bewaartermijn
- Accountgegevens: bewaard zolang uw account actief is.
- Spraakopnames, transcripties en feedback: bewaard zolang uw account actief is.
- Na accountverwijdering: alle persoonsgegevens, inclusief spraakopnames, worden binnen 90 dagen na uw verzoek verwijderd.
- Geanonimiseerde analyses: gegevens die u niet meer identificeren kunnen onbepaalde tijd worden bewaard voor productverbetering.
- Wettelijke verplichtingen: waar de Nederlandse wet bewaring vereist (bijv. voor belasting- of fraudepreventiedoeleinden), zullen wij gegevens bewaren voor de wettelijk vereiste periode.
08Gegevensbeveiliging
Wij beschermen uw gegevens met industriestandaard-maatregelen, waaronder:
- TLS/HTTPS-encryptie voor alle gegevens onderweg.
- Encryptie bij opslag voor opnames en databasegegevens.
- Bcrypt-wachtwoordhashing.
- JWT-gebaseerde authenticatie met kortlevende toegangstokens.
- Rolgebaseerde toegangscontroles binnen ons team.
- Regelmatige beveiligingsbeoordelingen van onze infrastructuur.
Geen systeem is 100% veilig. Wij stellen u en de Autoriteit Persoonsgegevens op de hoogte van datalekken zoals vereist door AVG-artikelen 33 en 34.
09Uw rechten (AVG)
U heeft de volgende rechten ten aanzien van uw persoonsgegevens:
- Recht op inzage (Art. 15): vraag een kopie op van de gegevens die wij over u bewaren.
- Recht op rectificatie (Art. 16): onjuiste of onvolledige gegevens laten corrigeren.
- Recht op gegevenswissing (Art. 17): verzoek tot verwijdering van uw gegevens ("recht om vergeten te worden").
- Recht op beperking (Art. 18): de verwerking van uw gegevens beperken.
- Recht op overdraagbaarheid (Art. 20): uw gegevens ontvangen in een machineleesbaar formaat.
- Recht van bezwaar (Art. 21): bezwaar maken tegen verwerking op basis van gerechtvaardigd belang.
- Recht om toestemming in te trekken: u kunt eerder gegeven toestemming op elk moment intrekken.
- Recht om een klacht in te dienen: bij de Autoriteit Persoonsgegevens via autoriteitpersoonsgegevens.nl.

10Accountverwijdering
U kunt op elk moment verwijdering van uw account en bijbehorende gegevens aanvragen:

Na ontvangst van uw verzoek verwijderen wij uw persoonsgegevens binnen 90 dagen. Sommige gegevens kunnen worden bewaard waar wettelijk vereist.
11Privacy van kinderen
De App is bedoeld voor gebruikers van 13 jaar en ouder. Wij verzamelen niet bewust persoonsgegevens van kinderen onder de 13 jaar.
Voor gebruikers in Nederland en de EU tussen 13 en 16 jaar vereist de AVG (zoals geïmplementeerd in Nederland via de UAVG) verifieerbare toestemming van een ouder of voogd voor de verwerking van persoonsgegevens. Als u tussen 13 en 16 bent, zorg dan dat uw ouder of voogd toestemming heeft gegeven voor uw gebruik van de App.
Als wij ontdekken dat wij gegevens hebben verzameld van een kind onder de 13 jaar (of onder de 16 jaar zonder ouderlijke toestemming in de EU), verwijderen wij deze direct. Ouders of voogden die vermoeden dat hun kind persoonsgegevens heeft verstrekt, kunnen contact opnemen via jackyvanderstarre@gmail.com.
12Wijzigingen in dit Privacybeleid
Wij kunnen dit Privacybeleid van tijd tot tijd aanpassen. Wij stellen u op de hoogte van materiële wijzigingen via de App of per e-mail. De datum "Laatst bijgewerkt" bovenaan weerspiegelt de meest recente herziening. Voortgezet gebruik van de App na wijzigingen geldt als acceptatie van het bijgewerkte beleid.
